Terms of Use

This is an English translation provided for convenience. The Portuguese version is the legally binding text, as Kivow is operated from Brazil and governed by Brazilian law.

1. Acceptance of terms

By downloading, installing or using the Kivow application (the "App"), you (the "User") declare that you have read, understood and agree to these Terms of Use (the "Terms"). If you do not agree with any part, do not use the App.

These Terms constitute a legally binding agreement between you and F. Kennedy Carlos Leite LTDA — trading as Kivow Sport Tech —, registered under Brazilian company number (CNPJ) 68.052.254/0001-97 (the "Controller"), established in Brazil. Use is also subject to our Privacy Policy, incorporated herein by reference.

2. Service description

Kivow is a cycling and running application and sports social network that allows you to:

  • Record and track cycling and running activities via GPS, or import FIT/GPX/TCX files
  • Connect partner platform accounts (Garmin Connect, Strava, Wahoo, iGPSPORT) to import activities automatically — see section 4
  • Take part in rankings by sport, discipline, city, state, country and gender
  • Interact with the community: profiles, feed, groups, chat, challenges and Segments
  • Buy and sell on the Marketplace (bikes, shoes, parts and accessories)
  • Hire coaches and access insurance quotes with partners
  • Use Kivow Cuida — route sharing, SOS and crash detection

3. Registration and account

To use Kivow you must create an account with truthful and up-to-date information. You are solely responsible for keeping your credentials confidential, for all activity carried out under your account, and for notifying Kivow immediately in case of unauthorized use.

It is forbidden to create accounts with false data, use someone else's account without authorization, or create multiple accounts to manipulate rankings or reputation systems.

4. Connected accounts from partner platforms

Kivow allows you to connect, if you wish, your account on third-party platforms that store your activities — for example Garmin Connect, Strava, Wahoo or iGPSPORT — to import your workouts automatically. The connection is optional, initiated by you and authorized through the OAuth 2.0 protocol, on the platform's own page. Processing of this data is described in our Privacy Policy (item 2.10).

By connecting an account, you understand and agree that:

  • Use of each platform remains governed by that platform's own terms and policies, to which you remain bound — Kivow is not a party to that relationship
  • You declare that you are the holder of the connected account and have rights over the data you import
  • Kivow does not guarantee the availability, continuity, accuracy or integrity of data provided by the source platform — we depend on what it sends us
  • The platform may change, restrict or terminate access at any time, at its own discretion; this does not constitute a failure by Kivow, even if we stop receiving new activities
  • We respect the usage restrictions imposed by each platform. Where the source determines that data may only be displayed to the data subject, it remains visible solely to you and does not feed rankings, groups or the public feed
  • You may disconnect at any time, through Kivow's settings or the platform itself. Activities already imported remain in your account until you delete them
  • The Connected Platforms, as well as their suppliers, licensors, affiliates and service providers, shall have no liability to you arising from your use of Kivow. The limitations of liability, warranty disclaimers and indemnification provisions set out in these Terms apply equally, and for the benefit of, those platforms and their data providers, to the maximum extent permitted by applicable law. Data received is provided "as is", and the modification, suspension or termination of any integration shall not give rise to any right to compensation

5. Health and safety notice

IMPORTANT: cycling and running are physical activities that involve health and safety risks. By using Kivow, you acknowledge that you practise at your own risk.

  • A medical evaluation is recommended before starting or intensifying sports practice
  • Wearing a helmet and appropriate safety equipment is your responsibility
  • Complying with the Brazilian Traffic Code and local laws is mandatory
  • Metrics provided by the app (speed, pace, distance, heart rate) are sensor estimates and may contain inaccuracies
  • App content does not constitute medical advice; consult a healthcare professional
  • Kivow is not liable for accidents, injuries or damages arising from sports practice

Routes and segments. Kivow lets you create, follow and share routes and segments, including routes created by other users. Kivow does not verify whether a route exists, is legal, is up to date, is suitable for your discipline or is safe. Following any route is at your own risk: assess road conditions, traffic and local laws before and during your ride or run. To the maximum extent permitted by law, Kivow is not liable for accidents, fines, trespassing or damages arising from the use of routes or segments.

Third-party maps and data. Kivow displays maps, satellite imagery and elevation data provided by third parties (for example, OpenStreetMap, CARTO, Esri/Maxar and elevation-model sources). Such data belongs to the respective providers, is subject to their terms and is provided "as is", without any warranty of accuracy, timeliness or availability. Kivow is not responsible for inaccuracies in maps, altitude, positioning or imagery.

6. Kivow Cuida

Kivow Cuida is a safety assistance feature (route sharing, SOS and crash detection). By using it, you understand that:

  • It depends on internet and GPS signal — in areas without coverage, it may not work
  • Crash detection is sensor-based and may produce false positives or negatives
  • It does not replace emergency services (in Brazil: SAMU 192, Fire 193, Police 190) — in an emergency, call them
  • You are responsible for configuring and testing the feature with your contacts before relying on it
  • Kivow is not liable for communication failures, lack of signal or damages arising from non-functioning in emergency situations

7. Marketplace

Kivow's Marketplace is a connection platform between buying and selling users. You understand and agree that:

  • Kivow is not a party to transactions and does not sell the products listed by users
  • Kivow does not guarantee the existence, quality, safety, legality or delivery of products, nor the truthfulness of listings
  • Negotiation, payment, delivery and any disputes occur exclusively between buyer and seller
  • It is up to you to evaluate the other user and take precautions before buying or selling
  • Kivow may remove listings that violate these Terms, without prior notice

8. Insurance with partners

Kivow is not an insurer. We act exclusively as a bridge/intermediary, connecting you to partner insurers for quotation and contracting.

  • The insurance contract is entered into directly between you and the partner insurer, governed by their conditions
  • Kivow provides no coverage, does not assess claims and is not responsible for approvals, refusals, coverage, exclusions or indemnities
  • Any questions about the policy must be addressed directly with the insurer

9. Coaches

Kivow connects athletes to independent coaches. Kivow is not an employer of the coaches and does not provide the coaching service. The relationship, the plans, the results and the technical responsibility lie exclusively between you and the coach you hire. Follow training plans with common sense, respecting your limits and medical guidance.

10. Kivow Pro — subscription

Kivow Pro is an optional plan with advanced features. By subscribing, you agree to:

  • Current prices: R$ 19.90/month or R$ 129.90/year
  • Automatic renewal for the contracted period, until you cancel
  • Cancellation at any time through the app or the store; access remains until the end of the paid period
  • No refunds for unused periods after cancellation, except where required by law
  • Price changes communicated at least 30 days in advance
  • Payments are processed by third parties (App Store, Google Play and/or gateways); Kivow does not store card data

11. User content

By publishing content (activities, photos, comments, routes, listings), you retain intellectual property and grant Kivow a non-exclusive, worldwide, royalty-free and transferable licence to display, reproduce and distribute that content on the platform and in promotional materials. You warrant that you hold the necessary rights and agree not to publish illegal, offensive, discriminatory, hateful, pornographic content or content that infringes third-party rights. Kivow may remove content that violates these Terms, without prior notice.

Kivow does not create, endorse or verify content posted by users (routes, listings, reviews, coach information and other posts), nor does it warrant the accuracy of third-party statements. Interactions and dealings with other users and partners are your responsibility; exercise caution before acting.

Suggestions, ideas and feedback you send to Kivow may be used freely by us, without confidentiality and without any compensation.

12. Community guidelines

Kivow is a welcoming platform for all athletes. The following are expressly prohibited:

  • Harassment, bullying or discrimination of any kind
  • False, misleading content or spam
  • Ranking manipulation by fraudulent means (use of motor vehicles, false data, etc.)
  • Creating multiple accounts to manipulate platform systems
  • Invasion of privacy or publication of third-party data without consent
  • Use of the App for unauthorized commercial purposes

Non-compliance may result in suspension or permanent account deletion.

To report content, listings or conduct that violates these guidelines, use the reporting feature available in the app or write to suporte@kivow.com.br. We review all reports and may remove content and suspend accounts according to severity.

13. Intellectual property

Kivow, its brand, logo, visual identity, interface, source code and other elements are the exclusive property of the Controller. Reproducing, modifying, distributing, decompiling, reverse-engineering or creating derivative works without express written authorization is forbidden.

If you are a rights holder and believe that content published on Kivow infringes your intellectual property, write to suporte@kivow.com.br providing your contact details, the identification and location of the content within the app, a description of the right allegedly infringed and a good-faith statement. We may, at our discretion and in accordance with applicable law, remove the content and take measures against repeat infringers. This channel does not replace any applicable judicial remedies.

14. Limitation of liability

To the maximum extent permitted by Brazilian law:

  • The App is provided "as is" and "as available", without warranties of any kind
  • Kivow does not guarantee uninterrupted, error-free or fully secure operation
  • Kivow is not liable for indirect, incidental, punitive or consequential damages
  • Kivow's total liability, in any case, shall not exceed the amount you paid in the last 12 months
  • Kivow is not responsible for routes, listings, third-party services (insurers, coaches, sellers) or road conditions — always check before training

15. Indemnification

You agree to indemnify and hold harmless Kivow and its Controller from any claims, losses, damages, liabilities and expenses (including legal fees) arising from your use of the App, your breach of these Terms or your infringement of third-party rights.

16. Service availability

Kivow strives to keep the app available but does not guarantee uninterrupted availability. We may suspend the service for maintenance, updates or in force majeure situations, giving advance notice whenever possible.

17. Termination

You may close your account at any time through the app or by writing to contato@kivow.com.br. Kivow may suspend or terminate accounts in case of breach of these Terms, with or without prior notice, depending on severity. Upon termination, your data will be handled according to the Privacy Policy.

Deleting your account removes your personal data, as described in the Privacy Policy. Contributions already incorporated in anonymized or aggregated form into collective and competitive features (for example, ranking and segment history) — which do not allow you to be identified — may be retained to preserve the integrity of those features. Deleted data cannot be restored.

18. Changes to these terms

We may modify these Terms from time to time. Material changes will be communicated at least 15 days in advance through the app and/or by email. Continued use after that period constitutes acceptance.

19. Governing law and jurisdiction

These Terms are governed by Brazilian law. The courts of the User's domicile in Brazil are elected to settle disputes, waiving any other, however privileged.

20. General provisions

  • If any provision is held invalid, the remaining provisions shall remain in full force
  • Kivow's failure to exercise any right does not constitute a waiver of it
  • These Terms constitute the entire agreement between you and Kivow regarding use of the App
